    Hi,

    Can the work experience without H1B be countable when you apply for I140 (EB2, BS + 5yrs ) ?
    I kept my part time job about 3 yrs while I was working as a full timer at other companies. But the problem is I was getting paid but didn't file H1B as a part timer. I know that I should have filed for H1B but I just had a H1B as a full timer with my other company. If I can count my part time work experience ( 3yrs part time / 2 = 1.5 yrs as full time) along with my full time experience (3.7 yrs), It exceeds 5 yrs of related work experience that requires for EB2.

    To be working on part time while on H1-B for an employer that is not the one who sponsored your H1-B is not legal. Please refer to a heated discussion currently under way in the Away-Qxter discussion topic.

    Hi,

    If I enter using H1-B/L1visa then I-94 validity end date will be ususally till the visa expiration date.

    Suppose if I am entering US on Advanced Parole(I-131), what will be the validity enddate for I-94? If suppose they give for 1 year how to extend that if i am not going out-off US?

    If you use AP to enter, your I-94 expiry date will be 1 year from the date of entry. You do not have to extend I-94, you are in AOS while you are in the country as long as your 485 is pending.

    Hi ,
    I received NOID on my i 485 (to be precise here is what it states)
    1)" 140 filled on behalf of you has been revoked by my previous employer ,also mentioned as it is after 180 days of filling my 485 ,but my application still valid with in the meaning of section 204 of the act.
    but they asked for employment verification letter from my recent employer with duties,educational qualification and offered wage of salary as it is .
    2) Inmatter of semerjian ,it was held that an immigrant alien with in the purview of section 212 (a)(14) must establish a bona fied intent to work in USA,immediately or in fore seeable future,in his or her qualifying endeavour or in a related field.
    3) It was further held in matter of tanaham ,18 I & N dec.339(reg.comm.1981)under section 245 of act who meets the objective pre requisites is merely eligible to apply for adjustment of status. when an alien seeks the favourable exercise of discretion by this service ,it is incumbent up on alien to establish that he or she merits adjustment

    what does number 2 and 3 mean? what should be provided in evidence to that?Please advice.

    The date on the notice is june 23 rd ,but i received my mail 2 weeks back to the adress where i work.(say july 24 th)

    Responded to my RFE with EVL (emploment verification)way back in august 2008 through attorney .so considering the date on notice that is june 23 rd. 33 days time has passed.but when i consider the date i received i still have time,which date should i consider,iam confused....,is it OK if i send my reply next week.Now iam worried,as just now i came to know about my letter from uscis(no online update though). what to do now,iam worried ,please advice.

    I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

    Hi,
    I have a pending I-485.
    My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

    You PD has to be current to file I-485 for you spouse/dependent. Since you filed for I-485 in Jun '05, and based on ur PD, i guess ur case must be EB2. If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

    Watch for April VISA BULLETIN, The DOS publishes this ususally sometime in first 2 weeks of each month for the following month. If the Date moves forward you should be able to file sometime in April, assuming the Date moves forward. Also you can use this time to prepare the application.

    This is really a contentious issue both in the pro and anti immigration communities and it is surprising that it has taken this long for one of the major advocacy groups to raise the issue publicly. . Pro-immigration groups are divided on the strategy question of whether allowing measures to go piecemeal will peel off support for some of the tougher measures like a legalization program.     as they lottery notification papers tell you - continue with all other immigration petitions.
    the petitions are completely separate - take the GC with the petition that is adjudicated first and that's what I plan to do.

    You can get quite far using just Blend, but you probably want to use Visual Studio for the coding and debugging features that Blend doesn't have.

    Hello,

    I needed your advise whether i have a case to file an APPEAL to USCIS granting me 1 yr H1 extension (beyond 6th Yr) instead of 3 yr extension.?

    Recently my 7th yr extension was approved for 1 year in Jul'09 with petition valid date till june'09 (date in the past) . At the time of filling the 7th yr extension, my I140 was not approved but during the processing of my h1 extension my I140 got approved and i had sent the approval copy along with an RFE i recieved in May'09.

    Let me give my case background in details.

    * LC applied in oct'07
    * I-140 applied in May'08 after LC approval
    * 6th yr on H1 ended in June 08
    * had to return India since my LC < 1 yr and I-140 was not approved
    * Employer based on an attorney's advise suggested to apply my 7th yr extension from India once my LC is one yr old (i.e. Oct'08)
    � Mar09- applied 7th yr extension based on Approved LC (> 1 yr old ) and applied I-140
    � Apr09- I-140 approved
    � May09 � Received RFE on H1 extension, replied along with a copy of Approved I-140 hoping to get 3 yrs extension
    � Jul09 � Received approval on H1X extension for 1 year with petition valid till Jun'09 (1 yr extension)

    Appreciate your advise on the same.

    Hello All,
    I got my US green card in EB3-I category through consular processing after an interview in Montreal, Canada in 2004.
    My PD is 29 March 2002. My family could not accompany me to the interview and hence they did not get their green cards at that time. I wanted to schedule an interview for them since 2008 and the Montreal Consulate informed me that my PD is not current. This is somewhat strange as I have already got my Green card in 2004. I have tried all options but everyone tells me that I have to wait till my PD becomes current. I am not a US citizen yet. The way EB3-I is going it will be easily another year till my PD becomes current. (The PD date has moved by 1 month in the last 6 months)

    I will appreciate if anyone has any suggestions for me.

    No it is not but the chances of getting a stamp is higher or at least it use to me.

    I remember going through the same thing few years back but then economy was not as bad it is today. Always remember the guy's job at US Embassies is to stop people from coming or act like a gate keeper.

    Just carry all your supporting documents like:

    Tax returns
    Offer letter
    Letter from the company stating your continuous employment
    Pay stubs
    Bank statemen
    ts and any assets you might have in the US (property, etc.)

    Who will be responsible for psychological torcher with less then 50% pay.
    Socially isolated coz of not driving.
    How one can see the big time loss of applicant.
    3 years easily one can wait can say but why for more then 6 yers.
    Who are talking time management that didn't applies here.
    Who are talking productinve loss for applicant who can earn more then 80k coz of LC approval not who is responsible.

    1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks
