I thought it would be considered fraudulent. I don't know why they didn't wait until the L1 application was approved first before coming over - it was only a week later? It makes no sense.

Participating in rallies, meeting with your lawmakers, exercising your civic duties, and enjoying your civil rights granted by the Constitution are not grounds for denial or rejection of petitions and applications or any other adverse action on immigration petition or application.

No, an employer cannot simply take action against you for having exercised your Constitutional right granted by the first amendment. I am sorry PnjbIndia, I am not at all familiar with cross chargeabilty. Maybe you do have to wait for her FP but I can't be certain. Have you considered doing an INFOPASS appointment? Wish you all the best and hope that you will get good news soon!!!!!

When I applied for my wife's AOS 3 weeks ago as a derivative, my lawyer also wrote in the cover letter to consider my case in cross chargeability.
But I have not seen any LUDs on my case yet. One point is that , may be I have to wait till my wife has got her FP cleared? Or can I get my case approved before hers? My FP is cleared....
Do you think they can give me the GC before my wife? Or they both have to come at the sametime... she is my AOS dependent, but i am using her country for cross chargeability.... any thoughts....

My I-140 was approved 2 yrs back. I have more time on H1 like ..2 more yrs.
I'm planning to use my EAD or do H1 transfer. So far I have good relations with my employer.If I speak to my employer about my plans will he be able to hurt my case like thru I140 or any otherway?
After I switch jobs will I be able to go back to my old employer if I would want to .

Even if your employer revokes (unlikely as he will have to bear legal expenses on an issue that he cannot win) your 140, it will have no effect. All you have to do is be ready with your new offer letter and maintain the labor wages in your new employment. In previous years desi companies used to reuse the labor by revoking the 140 once an employee quits. Now labor reuse also has been plugged by USCIS. You can peacefully go ahead and change your employment.
Any reason that you want to go back to your old employer? Why quit in the first place than...

I am planning to shift employers and I have a question:
Company A applied for my green card and I have an approved I-140, passed the 6 month mark and now planning to shift jobs on EAD. I have an offer from Company B with a condition that my offer would be permanent upon approval of my green card. I cannot work for company B till I physically have my GC. In the mean time can I work for Company C ( in a completely different field) till my GC gets approved without any issues?
I am sorry, I don't have answer for your question, but the AC21 cases getting denial will certainly effect you as you are planning to use AC21.

As we file our taxes jointly and hence instead of making advance payments/estimated tax payments quarterly, cant I just have my employer(w2 based) withhold more money from my paycheck every month?

However I did not get any FP notice yet! Do you know if Biometrics is a requirement for issuing the physical green card and also any idea how long it takes to get the card from this point of time.

I like the idea of linking to the High-5 campaign a lot.
$5 sounds like a resonable donation for replies to a harrowing immigration question from experts who have lived it, seen it, done it.
BTW... Could we have a link that bring one to the paypal page directly where you could choose from a drop-down from $5, $10, $20... More like one click donation.
This would save potential donors from having to sift through the Contribution page and locate the place to click to get to the paypal page. It is likely lead to a lot of "conversions".

And the officer is to treat the I-140 and supporting docs (based on which your I-140 was already approved) as prima facie evidence of intent. So why are you worried? I recently renewed my license in Oklahoma and was surprised to find out that on top of shorter expiration date, now my license has “TEMPORARY” written across it. This is new rule that OK is applying for non-residents and non-citizens. Has any body else gone thru similar experience? I am outraged that now I will be discriminated every where. DL is used on day to day basis and every body will question me, suspect me as to why “TEMPORARY” is written on my DL. Even DL office was not sure when this new rule was implemented, how come police officers, general public will know about it. I feel ashamed to even show my DL now. I’ll get hard time getting loans etc b/c people will think I may move out any time as I am here “Temporarily”

Hello,
I want to make it clear that I have read the manual that came with my D70... But I seem to be having an issue that I'm not exactly sure of the cause whereas I haven't altered any of the settings since I purchased/recieved it... unless I did something without realizing it.
One of the very first pic's I took with my D70 was of the moon. As you can see from my attached (cropped) image, "in my honest opinion anyway", I think they came out awesome rather decent for being taken "handheld" via a Sigma 300 mm kit lens...
Anyway... I took maybe a half dozen Moon'shots over the following couple of nights and everyone of them was "in focus" and relatively clear as the attached image... I proceeded to take other shots of various subjects over the following couple of weeks until one night the sky was crystal clear and there was a 3/4 Moon. I attempted to take the picture the exact way I took them the first couple of nights, with everything at its "default" settings (unless as I said I changed something without knowing)... What I found has left me bewildered. I can aim at & focus the Moon in crystal clear within the center brackets and then proceed to press the shutter release... only now "every single shot" will in the end, be nothing more than a gaint fuzzy snowball. I've even attempted taking a shot via the "Timer Release" feature whilest the D70 is mounted to a Tripod on solid ground, and its always the same thing. The image in the viewfinder is as "crystal clear" as I could ever hope for, yet when the picture is actually taken its a giant fuzzy snowball.
As I stated above, I've gone through the manual while looking at the camera in hand but I in no way remember ever changing anything where as this is my very first "fully adjustable" camera of anykind, digital or otherwise...
Any help would be truely appreciated...

I claimed my parents as dependents. You only need ITIN and have to do paper filing first time....
I also have notarized passport, etc, but one of the tax consultants told me that the ITIN cannot be filed now, and when I file my 2008 returns in 2009, I need to apply for the ITIN along with the taxreturn and paperfile. Has anybody else applied ITIN before filing tax return ?

How did you guys find out your Name Check Status. Do we have to call USCIS to check for this or is there any other way to confirm this.

I took an InfoPass appt. at the local USCIS Office and the IO there was quite willing to share information. He told me my FP returned with "no record" and my NC (same as BC) came out clean and was nice enough to confirm the same thing for my wife (even though she wasn't at the InfoPass appt. herself).
InfoPass appts are generally a crap shoot - if you are lucky you will get quite a bit of info, else the cold shoulder treatment.
But for sure, calling the USCIS office won't give you any info reg. the status of these checks.

I was thinking the same, to have my wife work on EAD.. so does that mean she will have to give her H4 away to work on EAD. Will that any issue while she travels and comes back on AP. I know it should not but just wanted to conform on the same.
Now also can you suggest on the scenario somehow I get a denial of 485 , what then my wife will have to do ? will she have to go back to the India and get a H4..

1) While filing AP online it asks if I want to add more filings. I want to add my wife's I-131 as well. Also my wife is a derivative beneficiary of my pending 485. So, my question is should my wife and my AP supporting documents be mailed in the same packet, even though I will
create 2 separate files in the same packet. Please advise. Else, how will they know that my wife's AP renewal is linked to mine.
2) There is a section which asks for the data of Intended departure. In paper based filing i would type unknown at present time. But in e-file, i cant type that in the date field. Can I leave this field and the length of stay blank ?
3) Part 7 Info for me asks only if my trip is for single entry or multiple entry. It does not ask for any supplemental Info. What is this supplemental info people talk about ?

Approvals started happening only in JUNE, JULY, AUG, SEP.
So all applications till first few weeks of JUNE have got VISA numbers and are getting approved.
Those who filed after JUNE 15th, need to wait till next week i.e Oct 1, to get VISA assigned.
But only those current in Oct will get VISA number assigned.
Also worry is they may take it easy and wait till next May/June to start the RUSH or if they keep the pace, then the july fiasco is acutally a boon to all waiting . Imagine, the GC process time is 3-4 months now instead of years.

I applied for my I-485 AOS and EAD-OPT card for my wife at the same time (June last week) .My wife is on F-1.We decided to apply for the EAD-OPT since there were rumors of the July 2 retrogression.She received her EAD-OPT in Sep (EAD to start Oct 1 ) and received her I-485 EAD on Oct 5 (EAD to start Sep 27).
Should she use her OPT-EAD or I-485 EAD ?
